Terms of Service

1. Acceptance of Terms

By accessing or using PE 360 ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Platform on behalf of a school, district, or other organization, you represent that you have the authority to bind that organization to these Terms. If you do not agree, you must discontinue use immediately.

2. Description of Service

PE 360 is a physical education management platform that provides tools for lesson planning, attendance tracking, student assessment, grading, and reporting. The Platform is designed for use by schools, school districts, instructors, coaches, and authorized administrative personnel.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials, including passwords and multi-factor authentication settings.
  • You agree to notify us immediately of any unauthorized access to or use of your account.
  • You are responsible for all activities that occur under your account.
  • Account access is role-based. You agree to use only the features and data authorized for your assigned role(s).

4. Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose or in violation of any applicable local, state, national, or international law
  • Attempt to gain unauthorized access to any part of the Platform, other accounts, or computer systems
  • Interfere with or disrupt the Platform's infrastructure, including attempts to circumvent rate limiting or security measures
  • Share, distribute, or expose student data or other personally identifiable information outside of authorized use
  • Use automated scripts, bots, or scrapers to access the Platform without prior written consent
  • Upload malicious content, viruses, or any material that could harm the Platform or its users

5. Student Data & FERPA Compliance

PE 360 processes student education records on behalf of schools and districts as a "school official" under FERPA. Schools and districts retain ownership and control of all student data. We process student data solely for the educational purposes specified by the contracting institution. Our data handling practices are detailed in our Privacy Policy.

6. Intellectual Property

The Platform, including its design, code, features, logos, and documentation, is the property of PE 360 and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Platform in accordance with these Terms. You may not copy, modify, distribute, or reverse-engineer any part of the Platform.

Content you create within the Platform (such as lesson plans and custom activity types) remains your intellectual property. You grant PE 360 a limited license to store and display this content as necessary to provide the service.

7. Service Availability & Modifications

We strive to maintain high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable for maintenance, updates, or due to circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any feature of the Platform with reasonable notice.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PE 360 AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU (OR YOUR ORGANIZATION) FOR USE OF THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE ERROR-FREE OR THAT DEFECTS WILL BE CORRECTED.

10. Termination

We may suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the Platform ceases immediately. Schools and districts may request a copy of their data by contacting us prior to or following account termination, subject to applicable data retention policies.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to the courts of competent jurisdiction in the State of California.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via the Platform or email. The "Last Updated" date at the top reflects the most recent revision. Continued use of PE 360 after changes constitutes acceptance of the updated Terms.
